BEGINNERS PACKAGE TERMS OF SERVICE

I understand that the 3 month Beginners Fundamentals memberships will automatically enroll the student(s) in the Mr. Miyagi 2 classes per week (2x/week) monthly recurring membership.  This will occur 90 days from the signup date of the Beginners membership.
 
In order to upgrade or cancel the automatic enrollment you must contact us anytime before your beginners package ends.
 
If you do not inform us of your desire to cancel before the automatic enrollment you may not receive a refund of the charge.  

RECURRING MEMBERSHIP Terms and Conditions

We do not require contractual commitments from our students here at Yamasaki Academy Woodbridge.  We do not use collection agencies that can affect your credit rating to collect remaining balances.  You can cancel or put your your recurring memberships on hold at any time.  Should your recurring, automatic payment fail you will receive automated notifications from our system for up to 7 days. 
 
If you have not made a payment within 7 days of a payment failure your membership with Yamasaki Academy Woodbridge will be terminated.  To reactive your account you will need to pay the remaining balance on your account plus a $100 reactivation fee.  
 
Any discounts or deals associated with your original membership may not be honored upon reactivation of your membership.  

WAIVER & RELEASE

Voluntary Participation

The Student or Guardian acknowledges and is fully aware that he/she has voluntarily applied to participate in the Instruction and related activities conducted by the Academy and the Academy Personnel. This Instruction includes, but is not limited to, exercises, instruction, drilling, sparring, and competition in the techniques and methods of the Academy’s martial arts programs which include, but are not limited to jiu-jitsu, judo, boxing, Muay Thai, kick boxing, mixed martial arts, and self-defense.

 

Assumption of Risk

The Student or Guardian hereby assumes any and all risks of injury or death caused either directly or indirectly by the Academy’s martial arts programs and/or the Student’s participation in the Academy’s martial arts programs.  Additionally, the Student or Guardian saves and holds the Academy and the Academy Personnel harmless from any and all personal injury claims and waives any such claims of any kind or nature whatsoever which may arise in connection with the Student’s direct or indirect participation in the Academy’s martial arts programs.

Legal Claim Waiver

The Student or Guardian hereby agrees that the Student, his/her spouse, parents, heirs, assigns, distributes, guardians, successors-in-interest and legal representatives will not make a claim against, or file any legal action of any kind or description against the Academy including, but not limited to, any action or claim for damages, injury, emotional distress, bodily injury, death or punitive damages due to or resulting from the Student’s participation in the Academy’s martial arts programs.

Video and Photograph Release

I hereby grant permission to the rights of my image, likeness and sound of my voice as recorded on audio or video tape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I also understand that this material may be used in diverse instructional settings within an unrestricted geographic area.
 
Photographic, audio or video recordings may be used for the following purposes:
 
  • website content
  • social media posts
  • instructional videos
  • on-line instructional courses
  • live streaming of instructional courses
  • student review of material
 
By agreeing to this release I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in the public educational setting. I will be consulted about the use of the photographs or video recording for any purpose other than those listed above. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. This release applies to photographic, audio or video recordings collected as part of the material and sessions listed on this document only. By agreeing I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing this material for educational purposes.
